Parties and Acceptance

These Terms of Service (“Terms”) are an agreement between you and Lomi Studio LLC (“PowerUp Apps,” “we,” “us”), a company operating from the United States (Virginia). By installing or using our apps, or by using powerupapps.com (the “Site”), you agree to these Terms. If you do not agree, do not use our apps or the Site.

Use of the Apps

You must use our apps in compliance with the terms of the platform on which they run (e.g., Wix, Shopify) and with all applicable laws. You are responsible for your store and for how you use our tools. We do not control your store content, operations, or your customers’ actions.

30-Day Money-Back Guarantee

For paid subscriptions, if you request a refund within the first 30 days of a subscription period, we will provide a full refund. Each new subscription or renewal starts a new 30-day window (for example, if you cancel and later resubscribe, the new subscription has its own 30-day guarantee). To request a refund, contact us at support@powerupapps.com within 30 days of the start of the subscription period.

Disclaimer and Limitation of Liability

Sales and results. We are not liable for your store’s sales, revenue, or business outcomes. Our apps are tools; we do not guarantee increased conversions, average order value, or profits. You use our apps at your own risk.

As-is. Our apps and the Site are provided “as is” and “as available” to the fullest extent permitted by law. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

Limitation of liability. To the maximum extent permitted by law, Lomi Studio LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claims arising from or related to these Terms or your use of our apps or the Site shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Subscription and Payment

Billing is processed through the platform where you subscribed (e.g., Wix, Shopify, etc.). Fees are as shown at purchase. Subscriptions may renew automatically unless you cancel according to the platform’s rules. We may change pricing or plans for new customers at any time, subject to the platform’s rules. Refunds are handled according to our 30-day money-back guarantee above.

Termination

We may suspend or terminate your access to our apps or the Site for breach of these Terms, misuse, or for any other reason we deem necessary. You may stop using our apps and cancel your subscription at any time through the platform. Sections that by their nature should survive (including disclaimer, limitation of liability, and governing law) will survive termination.

Intellectual Property and Ownership

Our apps, the Site, and all content and technology we provide are owned by Lomi Studio LLC (or our licensors). These Terms do not grant you any ownership or license to our intellectual property except the limited right to use our apps and the Site as described herein.

Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Virginia.

Changes

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Your continued use of our apps or the Site after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using our apps and the Site.
